Research objective: Understand how the representation of social actors in the Term of Transaction and Adjustment of Conduct (TTAC) in the case of the Samarco dam failure, in 2015, interferes in the confrontation of this corporate crime and influences the occurrence of similar ones
Theoretical framework: The collapse of the Samarco dam is characterized as a corporate crime (Medeiros; Silveira; Oliveira, 2018), this is our main theoretical framework. At the same time, in such a conflicting context, discourse plays a central role, so we use Norman Fairclough’s Critical Discourse Analysis as a theoretical and methodological framework.
Methodology: The present work used as information collection techniques the bibliographic and documental research. The analyzes were based on the Critical Discourse Analysis of the TTAC, specifically addressing the representation of social actors in that document.
Results: The representation of social actors in the TTAC legitimizes and superimposes the interests of the corporation over social interests, erases the victims from their discursive locus, leading to the continuity of the corporate domination over the case. Thus, the representation of social actors in the TTAC perpetuates the social factors that give permissiveness to the occurrence of corporate crimes.
Originality: Studies on corporate crimes have emphasized the negative effects of corporate actions. However, there is less engagement in the literature on the discursive processes that involve the contexts of these crimes. In this way, this article contributes to the elucidation of these discursive processes, since the corporate discourse of facing the crisis or instability is part of a process of managing impressions about the corporation, to create and maintain power resources (Medeiros; Silveira; Oliveira, 2018)
Theoretical and practical contributions: By analyzing discourse as a social practice, it contributes to the elucidation of strategies used by corporations in the face of corporate crime to maintain their hegemonic and ideological power in society.
