Fake News: A pragmatic analysis of the effects of the phenomenon on Journalism and Law

The article proposes a reflection on how the phenomenon of “fake news”, as a political strategy, has awakened transformations in Jornalismo e no Direito. Based on pragmatism, we analyze specific cases that contextualize and present consequences of the phenomenon in order to seek the possibilities for an effective freedom of expression in digital communication. For this, we adopt Park's (1940) notion of news as a form of knowledge and democratization of public interest in Dewey (1927).
